Terms of Trade

Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Golddust Seasoning Limited, (trading as KMC Seasoning “KMC Seasoning“) makes the products available to you (“Product Terms”).

By using KMC Seasoning you agree to these KMC Seasoning Terms. Please note that our Terms and Conditions also apply to your use of the KMC Seasoning website.

Availability

KMC Seasoning is only available in selected locations, and we only deliver goods to addresses in the United Kingdom.

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. To ensure availability of all our products customers may be limited to a maximum number of items.

To ensure that we can fulfil your order, there is a maximum weight and volume limit. Should your basket exceed these limits, you will be required to remove items until the basket is within the limits before you can complete the order.

Acceptance

Your order is an offer to buy from us. A contract is only formed when we have despatched your order. Up until the point of despatch, we may decline to supply the goods to you.

Delivery

All deliveries are subject to a delivery charge. Once you place your order, you agree to pay the delivery charge. The cost (if applicable) of any bags used to deliver your order will be included within the delivery charge.

KMC Seasoning deliveries will be fulfilled by a third-party supplier (Delivery Partner) and will be made to the address specified by you when you place your order.

The Delivery Partner will deliver your order to the main entrance of the delivery address.

For deliveries to customers at a business address, the Delivery Partner can deliver to the ground floor communal entrance of your business, but unfortunately, the Delivery Partner is not able to come to your desk. If your business has a shared ground floor reception, this is where we will deliver your shopping.

All goods must be received by an adult aged 18 years or over.

If the Delivery Partner attempts to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, your order will be cancelled. Our Customer Support Team will call you to notify you that your order has been cancelled. We reserve the right to retain the delivery charge and the cost of any perishable items. We will refund the price you paid for any non-perishable items.

We aim to make delivery within 5 working days of you checking out your order. However, whilst the Delivery Partner will make every effort to deliver all your goods in the agreed time, we will not be liable if the Delivery Partner fails to do so due to circumstances beyond our or the driver’s control.

Prices and VAT

All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items includes the delivery charge.

Prices for goods on KMC Seasoning may differ and be higher than the prices in partner stores.

Returns and Refunds

We’d like you to be happy with everything you purchase from KMC Seasoning. Unfortunately, your order or individual products cannot be returned to the driver at the point of delivery. If you have changed your mind about any of the products you have ordered, or if you are unhappy with any of the products, please call us on 0151 345 5880.

Please see our Returns and Refunds Policy for details of how to obtain a replacement or refund. Our refund policy is in addition to and does not affect any of your legal rights. If you have any complaints about an online transaction, please get in touch by email using sales@kmcfoods.co.uk or call us on 0151 345 5880 and we will work hard to find a solution.

If you would like to escalate your complaint, you can take the matter to Alternative Dispute Resolution (ADR). Although we do not participate in an ADR scheme, one such scheme is provided by Consumer Arbitration.

Changing your order

You cannot make changes to any of your current orders once your order has been placed.

Payment

We accept the following payment methods: Visa, Mastercard, American Express, Maestro, Visa Debit, Google Pay and Apple Pay. We don’t currently accept Visa Electron cards. If you do have an Electron card, please check with your issuing bank as they can upgrade your card to let you shop online with us. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of placing your order.

In order to help us validate your payment card, a card check will be performed automatically when you check out. At the time of delivery, full authorisation takes place whereby the total amount is requested from your bank.

Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired, we will be unable to take payment and fulfil your order.

General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

Our rights to make changes

Where we need to make changes to these terms and conditions, we reserve the right to do so in any of the circumstances listed below, by uploading a suitably updated version of these terms and conditions to the KMC Seasoning website:

  • or legal, regulatory or security reasons;
  • to implement reasonable technical adjustments and improvements; or
  • to ensure the ongoing operability of the services.

In addition, we may make material changes to these terms and conditions, by posting an update on our website or by other reasonable means, such as email.

Your continued use of the service will constitute your acceptance of any material change(s) that may have been made in accordance with the above arrangements.
